Commercial and Irrigation Wells, cause depletions to the South Platte River. To the extent those <br />depletions are out of priority, the purpose of this plan is to provide for replacement of such out of <br />priority depletions in time, location, and amount under the terms of this Decree. The Court <br />approves the following plan for augmentation subject to the terms and conditions of this Decree. <br />15. Structures to be Augmented. <br />15. 1. The Barlow Pit is located in portions of the SE1 /4SW1/4 of Section 33, T4N, <br />R57W of the 6th P.M. The source of water for the Barlow Pit is groundwater tributary to the <br />South Platte River. The Barlow Pit has Well Permit #66071 -F. Approximately 14 acres are <br />currently exposed to evaporation. Applicant's approved mining plan allows up to 40 acres of <br />exposed groundwater. <br />15.2. The Batch Plant Commercial Well is located in the N W 1 /4NEl /4 of Section 5, <br />T3N, R57W of the 6 P.M. at a point 660 feet south from the north section line and 1980 feet <br />west from the east section line of said Section 5. The source of water is groundwater tributary <br />to the South Platte River. The well has Well Permit No. 2104 -F. The Batch Plant Commercial <br />Well is used to provide water to Applicant's batch plant operations. The well was decreed in <br />Case No. W -4969 for 0.11 cfs, for commercial use, with an appropriation date of March 11, 1959 <br />and an adjudication date of December 31, 1972. <br />15.3. The Batch Plant Irrigation Well is located in the NW 1 /4NE1 /4 of Section 5, T3N, <br />R57W of the 61h P.M. at a point 1310 feet south from the north section line and 2320 feet west <br />from the east section line of said Section 5. The source of the well is groundwater tributary to <br />the South Platte River. The well has Well Permit No. R10298 -RF. The well was decreed as the <br />William Dorn Estate Well #10298 in Case No. W -4952, for 0.85 cfs, for the irrigation of thirty <br />acres in the vicinity of the Batch Plant in the NW 1 /4NE1 /4 of said Section 5, with an <br />appropriation date of October 31, 1950, and an adjudication date of December 31, 1972. The <br />decreed location of the well is the NW 1 /4NE 1 A of said Section 5 at a point 1095 feet south and <br />2505 feet west of the NE corner of said Section 5. <br />16. Replacement Wells. If Applicant should ever desire to drill a replacement well for <br />either the Batch Plant Commercial Well or Batch Plant Irrigation Well, Applicant shall obtain a <br />replacement well permit from the State Engineer for such well. Upon issuance of such permit, <br />the replacement well shall be automatically included in the plan for augmentation approved by <br />this Decree. Such replacement well(s) must be located within 200 feet of the well's decreed <br />location or the accounting and projection tools must be updated using the aquifer parameters for <br />the replacement well. <br />17. Water Rights To Be Used for Augmentation. <br />17.1 Applicant's Riverside Shares. The water derived from Applicant's Riverside <br />Shares will be released from Riverside Reservoir to provide augmentation water under this plan <br />and to replace historic return flows. Alternatively, upon agreement with the Riverside Irrigation <br />District and Riverside Reservoir and Company, Applicant will utilize recharge credits available <br />7 of 17 <br />
