Applicant shall collect and maintain monthly records of the volume of <br />water released from the subject reservoirs for augmentation and for return flow replacement <br />purposes under Applicant's plan for augmentation and change of water rights approved in this <br />Decree. <br />1 l .5 Accounting. Accounting for the use of the changed water rights shall be on <br />accounting forms acceptable to the Division Engineer. These forms shall be submitted on an <br />annual basis to the Division Engineer and Water Commissioner, or more frequently as required <br />by the Water Commissioner. The annual accounting shall also be provided to any Objector <br />making a written request for said accounting for that water year, upon payment of reasonable <br />copying and delivery costs. A sample accounting form is attached hereto as Exhibit D. The <br />accounting form may be changed from time to time so long as the information required pursuant <br />to this decree is included in the forms and such changes are approved by the Division Engineer <br />and Water Commissioner. <br />11.6 No Resolution of Issues Regarding Expanded Use Due to Changed Irrigation <br />Practices. Nothing in this Decree addresses or resolves the issue of whether or not future use of <br />the portions of the water rights related to Applicant's Riverside Shares and /or Jackson Lake <br />Shares changed by this decree may result in expansion of use of said water rights, and evidence <br />of use of said water rights may be presented in any future matter seeking a change of the <br />unchanged amount of all or any portion of said water rights. The preceding sentence shall not be <br />construed as limiting future actions with respect to expansion of use of all or any portion of said <br />water rights. <br />12. No Material Iniury. If operated and administered in accordance with the terms and <br />conditions of this Decree, the change of water rights requested will not result in material injury <br />to other vested water rights and should be approved. <br />13. Approval of Change of Water Rights. The change of water rights for Applicant's <br />Riverside Reservoir Shares and Jackson Lake Share is in accordance with law and should be <br />granted subject to the terms of this Decree. <br />PLAN FOR AUGMENTATION <br />14. Need for and Approval of Plan for Augmentation. The exposure of ground water in <br />the Barlow Pit, beyond the Exempt 2.7 Acres, and the diversions from the Batch Plant <br />6of17 <br />
