9.1. Ownership. Applicant owns one share of the Jackson Lake Reservoir and <br />Irrigation Company represented by stock certificate number 1513 ( "Applicant's Jackson Lake <br />Share "). Historical Use. Applicant's Jackson Lake Share was historically used as <br />supplemental irrigation water on land in Sections 19, T5N, R54W and Section 24, T5N, R55W <br />of the 6th P.M.(the `Boswick Farm "). This share was acquired by Applicant in 2006. A map <br />depicting the land historically irrigated by Applicant's Jackson Lake Share is depicted on Exhibit <br />C -3 attached hereto. <br />10. Proposed Changes. Applicant seeks to change the use of the water rights represented <br />by Applicant's Riverside Shares and Jackson Lake Share to add to their decreed irrigation use, <br />the following other uses: augmentation, replacement and exchange, with the right to fully <br />consume the consumable portion of the water, either by a first use, successive use, or disposition. <br />Applicant also proposes to deliver water available under the shares to the river for augmentation <br />credits pursuant to the augmentation plan described in this decree. Augmentation use will <br />include replacement of Applicant's out of priority depletions from the structures augmented <br />pursuant to this decree, and the replacement of historical return flows associated with the <br />changed shares. Applicant also seeks to change the decreed location of the Irrigation Well to <br />conform to actual location described in Section 15.3 below. No change in type or place of use of <br />the Irrigation Well is sought. <br />11. Terms and Conditions On Change. The change of the water rights represented by <br />Applicant's Riverside Shares and Jackson Lake Share shall be on the following terms and <br />conditions: <br />l l .l . System Losses. To prevent injury to other owners of Riverside and Jackson <br />Lake Reservoir water rights and other water rights, in determining the amount of water available <br />to the Applicant's shares in said reservoirs, the Applicant shall be assessed the same system <br />losses that are uniformly assessed to other owner's rights prior to release from said reservoirs. <br />4of17 <br />
