19. Calculation of Depletions. Depletions from use of the structures augmented by this <br />plan for augmentation will be calculated as set forth below: <br />19.1. Evaporative Losses from Barlow Pit. The surface area of the Barlow Pit will be <br />determined on an annual basis prior to May 31 of each year. Based on the NOAA Technical <br />Report NWS 33, the gross evaporation from the Barlow Pit is approximately 49.04 inches per <br />year. After adjusting for credit for depletions by pre- existing subirrigated cover on the area <br />inundated or to be inundated by the Pit, and effective precipitation, the net monthly evaporative <br />loss per acre for the exposed surfaced area of the Barlow Pit is as follows: <br />January <br />1.30 inches <br />July <br />0.37 inches <br />February <br />1.51 inches <br />August <br />0.50 inches <br />March <br />2.12 inches <br />September <br />0.93 inches <br />April <br />2.38 inches <br />October <br />1. 18 inches <br />May <br />2.12 inches <br />November <br />1.64 inches <br />June <br />1.47 inches <br />December <br />1.26 inches <br />No evaporative losses shall be charged for any portion of a month that the entire surface area of <br />the Barlow Pit is frozen over. <br />19.2 Priority of Right. For purposes of operation of this plan for augmentation, <br />evaporative losses from the Barlow Pit will be replaced only when there is a senior downstream <br />call. For this purpose, the Barlow Pit is hereby decreed a water storage right in the amount 800 <br />acre feet, with a ground water filling right in the amount of 0.4 cfs, and an appropriation date of <br />December 28, 2007, for in- storage beneficial uses only, such as aesthetic and fish and wildlife <br />purposes. The source of water is groundwater tributary to the South Platte River and local <br />runoff. <br />19.3 Water in Product. Water removed with the mined sand and gravel is estimated to <br />be four percent of the product by weight. Using this factor, the water contained in the product is <br />one acre foot per 34,014 tons of product mined. At maximum production, it is estimated that no <br />more than 100,000 tons of product will be mined in any given calendar year. Once mining <br />ceases, or in years when no mining occurs, no water will be lost in product. The water contained <br />in the product will be deemed withdrawn in the month that such product is mined. <br />19.4 Lagging of Depletions from Pit. The effect of withdrawals of water from the <br />Barlow Pit by means of evaporation and water in product will have a delayed depletive effect on <br />the South Platte River. The table included in the accounting form attached hereto as Exhibit D <br />sets forth the delayed depletive effect owed to the South Platte River in each month as a <br />percentage of such annual withdrawals. Applicant will augment all out of priority depletions <br />from the Barlow Pit during the month that such depletions affect the South Platte River as shown <br />on such table. <br />10 of 17 <br />
