SW' /4 Section 22 SE' /4 NE' /4 Section 28 SW' /4 SE' /4 Section <br />28 E%2 NW' /4 Section 33 W' /2 SW' /4 Section 33 The <br />additional study data will be forwarded to the Colorado Historic <br />Society for their evaluation and a determination of the proper <br />course of action required. <br />7 <br />The Colowyo Coal Company shall submit a TECHNICAL <br />revision to the Division which provides an analysis of <br />groundwater points of compliance at the Colowyo Mine <br />pursuant to Rule 4.05.13(l). This analysis will be done in <br />consultation with the Division and will include a written <br />determination of the need for groundwater points of compliance <br />at the mine. If deemed appropriate, based on this analysis, <br />Colowyo shall establish one or more points of compliance for <br />the Colowyo Mine. <br />10 <br />Prior to disturbing any lands along the Wilson Creek the <br />Colowyo Coal Company shall provide the Division with a <br />detailed analysis and discussion of the alluvial valley floor <br />(AVF) that has been documented in the area. Colowyo must <br />also provide a detailed plan for the restoration of the AVF if <br />and when it is disturbed. This analysis may be in the form of a <br />stand -alone revision or it may be contained in the revision <br />required in Stipulation 3. Any revision submitted must be <br />approved by the Division prior to any disturbance. <br />14 <br />Within 45 days after final approval of RN -06, unless Colowyo <br />adds a rider to their bond of $25,800,159.00, Colowyo will <br />provide a complete MR that contains a cumulative bond <br />schedule for the Colowyo Mine. <br />15 <br />PRIOR TO DISTURBANCE OF THE COLLOM <br />FACILITIES AREA, COLOWYO MUST REEVALUATE <br />SEDIMENT CONTROL STRUCTURES IN ACCORDANCE <br />WITH RULES 4.05.2, 4.05.5, AND 4.05.6. IN PARTICULAR, <br />TWO AREAS IN COLLOM THAT WERE PLANNED FOR <br />SAE STATUS, NAMELY THE 9.8 -ACRE CORNER OF THE <br />SHOP AREA AND THE 7.2 -ACRE AREA OUTSIDE DEER <br />DRAW, REQUIRE AN ALTERNATIVE PLAN. THESE <br />AREAS MUST BE REMOVED FROM THE DISTURBED <br />AREA OR RUNOFF FROM THESE AREAS MUST BE <br />ROUTED TO SEDIMENT PONDS. THIS WILL REQUIRE <br />RE- SUBMITTAL OF THE ASSOCIATED FIGURES, TEXT, <br />AND EXHIBITS FOR SEDCAD RUNS. <br />16 <br />IN ACCORDANCE WITH A RECOMMENDATION BY <br />USFWS (BIOLOGIC OPINION DATED OCTOBER 30, <br />2012), COLOWYO IS REQUIRED TO MARK WIRE <br />FENCING NEAR AREAS OF HIGH GROUSE USAGE IN <br />CONSULTATION WITH COLORADO DIVISION OF <br />PARKS AND WILDLIFE. <br />
