RIDER TO MINING PERMIT <br />Permit Date: November 5, 2012 <br />Permit No: C- 1981 -019 <br />The following additional stipulations form an integral part of the foregoing permit: <br />Stipulation No. <br />Description <br />2 Prior to disturbing any lands in the Lower Wilson area, the <br />Colowyo Coal Company shall provide the Division with a <br />PERMIT revision containing a mine plan and a reclamation <br />plan and any additional baseline monitoring information <br />(surface water, ground water, soils, vegetation, etc.) requested <br />by the Division. The approval of Permit Revision 02 is only an <br />approval for disturbance in the South Taylor Pit (South Taylor <br />Pit, West Valley Fill, East Valley Fill and associated <br />structures). NO DISTURBANCE IS APPROVED FOR THE <br />LOWER WILSON AREA WITH THE APPROVAL OF <br />PERMIT REVISION 02. <br />3 <br />Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on <br />seven areas identified as requiring more detailed study in the <br />October 1984 report titled "Cultural Resources Investigations in <br />the Danforth Hills Proposed Coal Lease Area; Moffat and Rio <br />Blanco Counties, Colorado; Consolidation Coal Company. <br />These areas are as follows: 5MF1652, 5MF1935, 5MF1937, <br />5MF4003, 5MF4010, 5MF4011 AND THE Bison Bone IN <br />THE CUT -BANK. The additional study data will be forwarded <br />to the Colorado Historic Society for their evaluation and a <br />determination of the proper course of action required. <br />4 Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on <br />the six areas identified on Map 16A as "unsurveyed areas ". <br />Additionally, Colowyo will be required to survey any other <br />areas that are determined to have no survey or inadequate <br />survey data. The six unsurveyed areas shown on Map 16A are <br />all within Township 4 North Range 93 West and are basically <br />described as follows: SW' /4 SW' /4 Section 15 SW' /4 <br />
