Mr. David Shohet <br />June 12, 2013 <br />Replacements <br />Page 2 <br />Valco is responsible for providing replacement water until the property transfer is completed. The <br />property transfer from Valco to Lamar is scheduled for April 30, 2013. As shown on the attached Table <br />1, the evaporation and replacement requirement for April 2013 is 6.29 acre -feet. Valco will dedicate 7 <br />preferred shares at 1 acre -foot per share to the plan for April. <br />Conditions of Approval <br />This substitute water supply plan is hereby approved pursuant to Section 37 -90- 137(11), C.R.S., <br />subject to the following conditions: <br />1. This SWSP shall be valid for the period of April 1, 2013 through May 31, 2013, unless otherwise <br />revoked, modified, or superseded by decree. Should an additional SWSP be requested, such <br />renewal request must be submitted to this office with the statutory fee of $257 per gravel pit at <br />least 45 days prior to the expiration date of this plan. <br />2. No more than 35.4 acres (22.2 acres of post -1981 exposure) may be exposed at the Lamar East <br />Pit during this plan year without first obtaining an amendment to the plan. <br />3. Subject to approval by the Division Engineer, the Applicant may lease or purchase additional <br />replacement water from the sources approved in this plan. The Applicant must provide a copy of <br />a lease /purchase agreement to the State Engineer's Office and the Division Engineer for use of <br />such additional replacement water. Should any of the leases expire prior to the expiration of this <br />plan, lease renewals must be obtained and submitted within 2 weeks of their expiration. <br />4. Approval of this SWSP is for the purposes stated herein. The State Engineer's Office must first <br />approve any additional uses for which the water may be used. The replacement water, which is <br />the subject of this SWSP, cannot be sold or leased to any other entity during the term of this <br />SWSP without prior approval of the Division Engineer. <br />5. Under this approval, the evaporative depletions associated Lamar East Pit have been assumed <br />instantaneous due to their proximity to the Arkansas River being within 100 feet. The Applicant <br />is hereby notified that any subsequent SWSP renewal for these pits must include <br />depletions that have been lagged to the Arkansas River. The lagging effect shall be based <br />on the distance from the centroids of the exposed ground water surfaces to the Arkansas <br />River. This will ensure that all replacements replace depletions in time, location, and amount. <br />6. The Applicant shall provide to the Division Engineer, within 30 days of the date of this approval, <br />an electronic Excel spreadsheet showing, by WDID, the owner or contact person name, address <br />and telephone number for each structure covered or used in this SWSP. The Applicant shall also <br />provide to the Division Engineer an updated version of this spreadsheet if there are any owner or <br />contact person changes within the approval period of this SWSP. <br />7. Release of the Pueblo waters must be under the Division Engineer's direction and approval. <br />B. The Applicant shall provide daily accounting (including, but not limited to diversions, depletions, <br />replacement sources, and river calls) on a monthly basis. The accounting must be emailed to the <br />Water Commissioner Joshua.Kasperaastate.co.us and to the Division Engineer (e -mail to <br />Div2Ground .Watert3-state.co.us), within 30 days of the end of the month for which the accounting <br />applies. Accounting and reporting procedures are subject to approval and modification by the <br />Division Engineer. Accounting forms need to identify the WDID number for each well operating <br />under this SWSP. NOTE: Monthly accounting, even during the winter non - irrigation season, is <br />required. <br />
