We have no <br />problem with the TR but feel it is appropriate to ask the Division to place some date for when the <br />structure they propose installing be will be completed. In May 2013 at a meeting with the <br />applicant, their engineers, myself and Lisa DelVescovo, Mr. Orr's representative and the Division, <br />we were assured the proposed fix they submitted in TR #1 would be installed as soon as the <br />Division approved the TR. The following timetable outline what they considered soon <br />• May 15, 2012 - Site meeting <br />• August 7. 2012 - Amended TR 01 filed based on meeting ( -84 days) <br />• February 14, 2013 - Al meets with Division and says the plan approved in TR #1 is too <br />expensive and promised to file a revised plan. (-132 more days) <br />• April 30, 2013 - Al files TR 02 to address promise in February 2013 (-75 more days) <br />• May 21, 2013 - Al files response to TR 02 adequacy ( -29 more days) total time —366 <br />(lass. <br />I guess their idea of shortly doesn't match mine and still no commitment date for when they will <br />install the temporary measures to relieve the impacts to Mr. Orr's land (that in my opinion won't <br />work). If you go back to the inspection, David Bird did on October 5, 2011 and his correction <br />date of January 4, 2012 that's nearly 503 days ago. Seems to me this is more then adequate time <br />to have addressed a permanent fix for the problem not just proposing a temporary fix. <br />Suffice it to say that I am skeptical that TR 02 will work as they say, even if it ever gets installed. <br />RECEIVED <br />JUN 0 7 ?013 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />
