Pineda <br />Director <br />The Division has reviewed the response provided by JE Stover and Associates on behalf of <br />Bowie Resources, LLC (BRL) to our adequacy questions with TR -77 for the Bowie No. 2 Mine. <br />The revision proposes the use of overburden materials as a substitute for topsoil in the Gob Pile <br />#2 area. In addition to the information provided in BRL's May 2, 2013 adequacy response, the <br />proposal was discussed during a meeting on May 30, 2013 at the Division offices. We have the <br />following comments and questions regarding the application. <br />1. DRMS: Revised page 2.04 -101 submitted with TR -77 indicates that select overburden <br />materials may be used as a replacement and or supplement for the topsoil on the coal <br />mine waste piles. The language used should be updated to specify "coverfill material" <br />may be used as a supplement to the topsoil material as this is the only type of overburden <br />material that was evaluated and considered for this use. The use of other types of <br />overburden material as a replacement and or a supplement to topsoil would require a <br />separate analysis with the justification and test results submitted to the Division for <br />approval in accordance with Rule 4.06.2(4). Please revise Page 2.04 -101 to clarify that <br />"coverfill material" is the only material that will be used as a topsoil supplement. <br />BRL: Text on page 2.04 -101 was revised to specifically state the use of 'coverfill' <br />material as a replacement or substitute to topsoil on the coal mine waste piles. <br />DRMS: Response accepted. <br />2. DRMS: The first sentence of item (3) on revised Page 2.04 -101, should be updated to <br />clarify that the coverfill material will only be used to "supplement" the available topsoil <br />material to be replaced.
