File No. M -1977 -215 <br />112 E. 12th Street <br />Creede, CO 81130 <br />Notice of Final Determination of Designated Mining Operation Status <br />Rio Grande Silver, Inc. <br />Re: Bulldog Mine, Permit No. M-1977-215, Final Determination of Designated Mining <br />Operation Status <br />Mineral County, Sec. 35 and 36, T42N, R1 W, NMPM, 60.0 affected acres, 112 Regular Permit, Lead - <br />Silver; Bulldog Mine. Pursuant to the Minerals Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Hard Rock, Metal and Designated Mining Operations ( "Rules" or "Rule ") Rule <br />7.2.4(1)(a), the Colorado Division of Reclamation, Mining and Safety ( "DRMS" or "Division ") hereby <br />posts the following Notice of Final Decision in the Monthly Board Agenda: <br />On February 25, 2013, the Division notified Rio Grande Silver, Inc. ( "Rio Grande Silver ") that the <br />Bulldog Mine is a Designated Mining Operation ( "DMO ") pursuant to Rule 1.1(14). This finding was <br />based on the fact that the site has the potential to disturb or expose acid- or toxic - forming materials. <br />Specifically, if waste rock or water potentially constitute acid- or toxic - forming materials, the site will <br />be assigned DMO status, pursuant to Rule 1.1(14). <br />Pursuant to the requirements of Rule 7.2.3(1), if the Operator agrees with this determination, then the <br />Operator is to notify the Division by mail of their concurrence within 30 days of the date the Operator <br />receives notice of the final decision and proceed to comply with the requirements of Subsections (2) <br />and (3) of Rule 7.2.3. Pursuant to Rule 7.2.4(1)(b), if the Operator disagrees with the final <br />determination, then the Operator may appeal the notice in writing to the Mined Land Reclamation <br />Board within 30 days of the date the Operator receives notice. As a DMO, Rio Grande Silver is <br />required to file with the Division the necessary elements of an Environmental Protection Plan, and <br />upon the Division's approval of its adequacy, amend the permit to include such plan, pursuant to Rules <br />7.2.3(2) and (3). <br />
