Exhibit Page 48 <br />Evaluation By establishing a 100 -foot circle around the two towers which are inside the permit <br />area, and ensuring that no activities on the permit area are within that circle, <br />assuming a maximum of 30 feet in working face height, assuming an angle of <br />repose of 37 degrees (that of loose sand and gravel), and using backfill to create <br />slopes not greater than 31­1:1 V around the towers, there will be no potential for <br />impact on the power lines. Since mining will use bucket (front -end) loaders, dozers, <br />and other similar equipment, the only other prohibition necessary to prevent <br />potential conflicts with use will be to prohibit erection of any processing plants or <br />stockpiles within the easement (100 feet either side of the centerline of the <br />powerlines). As stated elsewhere, the access road along the powerline will be <br />maintained in useable condition at all times by McStone Aggregates. <br />Structure Description /notes Owner <br />Barbed -wire Various 3- and 4- strand barbed wire fences are located on Landowner <br />fencing the property, including the perimeter. <br />Evaluation The lease for McStone Aggregates requires that the fences be maintained and if <br />necessary replaced if no longer serviceable due to mining operations. In addition, <br />McStone Aggregates has a direct interest in maintaining fence serviceability to <br />prevent cattle from entering the site and overgrazing areas being reclaimed. Based <br />on soil conditions, no impact is expected on fences, as based on past mining near <br />fencing in these conditions. Therefore, there appears to be no need for detailed <br />analysis or for an additional compensation agreement beyond the leases. <br />NOTE: Although the fence line just north of the permit boundary is owned jointly by <br />the McClellans and LMN Properties, the two owners have agreed in the past that the <br />fence line maintenance is responsibility of LMN Properties, since the McClellans are <br />not allowed to enter the LMN Property across the fence. <br />Structure Description /notes Owner <br />Roads Existing roads include roads improved and to be Landowner, and <br />maintained to county standards (as provided in the lease adjacent landowners <br />agreements), and older roads and trails (pre- mining) to be <br />replaced by county- standard roads as directed by the <br />landowner as part of reclamation work. <br />Evaluation There are presently no roads within 200 feet of the proposed Mining Area outside <br />this permit boundary except a small (10 -12 ft wide) unimproved dirt trail (and <br />therefore not a significant manmade structure) in the property belonging to LMN <br />Properties to the north, which will be protected by the same berming used to prevent <br />runon of storm water. This road may be mined out by operations of M- 1990 -025, to <br />"daylight" between the two operations and thus maximize the recovery of <br />construction materials for both operations. McStone Aggregates intends to <br />construct another road immediately south of the property line for permanent post - <br />mining use, which will be built as mining proceeds, and will further ensure that the <br />existing trail north of the boundary is protected. <br />Soils: Refer to Exhibit I. <br />This evaluation was prepared based on information obtained from the owners, from various agencies, <br />including USDA Natural Resources Conservation Service, US Forest Service, and Dolores Soil <br />Conservation District, and during site inspections and investigations conducted in between September <br />2011 and March 2013. <br />(SEAL) <br />/*&ak!5�1 <br />SIGNAMRE NATHAN A.
