Exhibit Page 39 <br />TRUCKS <br />A variety of trucks will be used to haul materials from the New Hay Camp Pit, including single <br />dump trucks, semi -dump trucks, and trucks with pups. Most commonly used will be dump <br />trucks with pups. Average haul for all vehicles will be 25 tons per vehicle. All trucks are <br />properly permitted for highway use and meet weight requirements for county and state <br />highways. All drivers have CDL (Commercial Drivers License) if required for the vehicle being <br />operated. <br />TRAFFIC COUNTS AND SCHEDULES <br />Based on average production and haul days, the traffic counts are estimated as shown in the <br />table below. Haul days available may vary from year to year, based on weather conditions, <br />road conditions, and truck availability. Watering of roads will not generally be used, due to <br />the lack of water on site and the current need to haul water several miles to the site. When <br />hauling material less than 1/4-inch size, haul trucks will be controlled to prevent dust, including <br />tarping (chemically or physically) in accordance with state and local requirements. If necessary, <br />hauling will be curtailed during extreme high wind conditions. <br />BLASTING AND NOISE CONTROL <br />Actions will be taken to reduce the impact of blasting and noise caused by the mine and <br />associated activities. <br />BLASTING <br />There will be no blasting done on site for the New Hay Camp Pit. <br />NOISE POTENTIAL <br />Due to the location of the site, located on the side and top of a high mesa, some <br />problem with noise is expected, as discussed above, and noise reduction is taken into <br />account in the overall design and selection of the berm /stockpile and the work area (at a <br />lower elevation on a flat), direction of working, and other noise control measures integrated <br />into the operation. <br />Typical sources of noise associated with sand and gravel extraction include operation of <br />mobile and stationary equipment (engine, conveyor and like noises), back -up alarms, <br />8 Based on an average of 25 tons per vehicle, for planning purposes. <br />9 Based on average 1 -hour round trip and average 10 -hour day, for planning purposes. <br />
