Exhibit Page 13 <br />Preparation before mining begins: <br />1. Marking (using PVC pipe "posts ") of areas to be affected for identification on the ground. <br />2. Maintenance and improvement of the roads along and in the WAPA easement between the <br />property entrance and the area to be mined. <br />3. Documentation of ground conditions (photographs and measurements) in the WAPA <br />easement (17.2 acres), particularly around pylons. <br />4. Preparation of the work area (5.8 acres) along the west side of the WAPA easement, <br />including stripping, segregating and moving this stripped material (soil and subsoil) to <br />perimeter berms /stockpiles (the perimeter berm to control storm water), and marking of <br />areas, with placement of aggregate base course for traffic areas. <br />5. Relocation of equipment from other sites to this site. Specifically, equipment relocated from <br />the Hay Camp Pit (M- 1990 -025) will be moved only by road and will NOT be moved "across <br />the fenceline" (a requirement of the landowner of M- 1990 -025 to the north). <br />Mining consists of: <br />1. stripping (with loaders, dozers, and scrapers as appropriate) and conserving topsoil <br />(ranging from 3" to 12" and assumed to average 6 "), moving this material either to berms/ <br />stockpiles (the perimeter berm) or directly to reclaim areas; <br />2. stripping overburden (same equipment) and moving this material either to stockpiles <br />(including perimeter berms) or directly to backfill areas; <br />3. removing of the sand and gravel (with loaders and /or backhoes) and moving these <br />materials to the processing plant or stockpiles for the processing plant; <br />4. crushing, screening, and /or washing (using portable, permitted plants) of sand and gravel <br />then moving these to product stockpiles prior to shipping from the site; and <br />5. use of excess fines (from screening) together with overburden for backfilling in the mining <br />area, either immediately, or after stockpiling. <br />Crushing and screening will be done with permitted portable plants brought to the site as <br />required. While unlikely, if plants are not brought on site, processing will be done at an off -site <br />location. Production is not expected to exceed 500,000 tons per year and will generally be less <br />than 100,000 tons per year. Haul on -site will use four -wheel loaders and rough- terrain trucks. <br />Initially, disturbance will be limited to: <br />1. Work area along access road (5.8 acres) <br />2. Haul road from north to south (improvements are intended to be permanent post - <br />reclamation features) between the entry, work area and the mining area (2.2 acres) <br />3. Construction of sediment basin and swales west of WAPA easement on south edge of <br />mining area and extending temporary access through Areas M and L to Area K <br />4. Stripping and preparing first area to be mined on the north edge of the site in Area K, with <br />grading along north boundary (including a permanent boundary road), establishing a <br />working face and floor, and producing mined materials to be hauled and processed. <br />5. Total: 16 acres more or less. <br />At least one face will be operated, however, it is expected that two faces may be used because <br />of the location and type of materials on -site. These areas will start at 2 -3 acres (item 4 above) <br />and expand to up to 5 acres before reclamation begins, and reclamation estimates are based <br />on this assumption. A single work area will be used, but may be divided into various areas <br />depending on material, equipment, and operations underway. Therefore, during most years of <br />operation, up to 22 acres will be affected and NOT in some stage of reclamation at any one <br />time. Of this, only 10 acres will actually be actively mined: the remaining 12 acres is roads and <br />work area (plant, stockpile, parking, etc.) As mining progresses, the plant may be left in the <br />same location, and the haul roads will be extended only in the area mined. The north boundary <br />road will be extended to the northwest corner of the site as a permanent, post - reclamation <br />
