6.4.5 Exhibit E - Reclamation Plan <br />Under the exhibit, the operator states, "The access driveways will be left intact once the <br />mining is complete ". Under the mining plan exhibit section" the operator states "The east <br />access driveway will remain after reclamation for landowner use ". Please explain which <br />driveways are to remain in place after reclamation. <br />6.4.7 Exhibit G - Water Information <br />1) Under the exhibit the operator states, "The water table in the area is substantially <br />below the surface in most cases at least 50 feet deep ". Did the operator determine <br />the depth based on actual data, or based on adjacent static ground water well <br />elevations? Please explain. If there is a potential to intercept ground water, the <br />operator must commit to backfill the exposed ground water to a minimum of two <br />feet above the exposure elevation. No water can be detained in the pit for more than <br />72 hours. <br />2) During the per - operational inspection, the Division observed the culvert along the <br />Frenchman Creek crossing for the access road. Based on what was observed at the <br />time of the inspection, it appears to be undersized to handle a designed flow for a <br />general storm water permit. It appeared to be almost plugged from the recent storm <br />events. The operator must commit to routine maintenance after a precipitation <br />event that generates flow through the culvert or provide a properly sized designed <br />culvert to handle at least the 10 year 24 hour event for Frenchman Creek. <br />6.4.13 Exhibit M- Other Permits and Licenses <br />Under the exhibit the operator states, "A storm water management plan will be prepared <br />for this pit if there is a potential for surface water leaving the site ". Given its location there <br />is a high rate of probability that under a set precipitation event, the potential exists for <br />affected drainage to leave the site. The Division recommends the operator obtain a general <br />storm water permit from the Colorado Department of Public Health and Environment. <br />Please acknowledge. <br />All other exhibits were found to have addressed the rules and regulations.
