RESPONSE: Exhibit E and Maps page M -2 Exhibits A/B, Page M -3 Exhibit C and Site <br />Description are corrected to include three man -made structures with -in 200 ft. of <br />the affected mining area: <br />1. Center Pivot Sprinkler. <br />2. Irrigation Ditch. <br />3.3 Wire Fence. <br />Please see the attached copy of the Operator /Structure Owner Damage <br />Compensation Agreements. <br />7. Please correct the scale on Map M -2. <br />RESPONSE: Please see attached maps pages M -2 and M -3. Scale has been <br />corrected to 1" =100' <br />8. Please resolve the apparent discrepancy between page 3 of Exhibit D and page 3 Exhibit E — <br />top soil replacement depth. <br />RESPONSE: Please allow for a change affecting both Exhibit D and Exhibit E <br />describing the corrected top soil replacement depth as 6 ". <br />9. In order to sufficiently describe the post mining topography, please add contour lines that <br />show the appropriate gradient of all reclaimed slopes. <br />RESPONSE: Please see page M -3, Exhibit D for added contour lines indicating <br />approximate lines of slope. <br />10. Please resolve the apparent discrepancy between the NRCS Custom Soil Resource Report <br />indicating an existing excavation with -in the proposed permit boundary and Exhibit E which <br />states "There are no previously mined areas, roads, or excavations resulting from utility <br />construction on the proposed site" <br />RESPONSE: Excavation is noted in the NRCS Custom Soil Report, however <br />it is understood that some soil, sand and gravel with -in the permit boundaries had <br />been gradually unearthed, stored and removed over the years exclusively for <br />personal use on the property Owner's farm. <br />GENERAL COMMENTS AND QUESTIONS <br />11. Please submit application form with correct spelling of the business trade name. <br />RESPONSE: Please see attached page one "Construction Materials Limited <br />Impact (110) Operation Reclamation Permit Application Form" with the <br />corrected applicant name Riverside Aggregates, LLC <br />12. The Division Suggests using a standard scale of 1" =100' on all maps <br />RESPONSE: Please see attached revised maps including 1" =100' scale <br />13. The Division suggests adding a 1" scale bar to each drawing. <br />RESPONSE: Please see attached maps pages M -2 and M -3. A 1" scale bar has <br />been added <br />14. Post mining land use — Pastureland or Rangeland? <br />RESPONSE: The post- mining classification is corrected to be rangeland. <br />General Comments: <br />Please note: <br />1. A copy of the May 6, 2013 letter from the State Historic Preservation Office has been <br />received and reviewed. Riverside Aggregates, LLC intends to state laws governing the <br />discovery of human remains as noted in the letter. <br />2.
