TO: TYLER O'DONNELL <br />STATE OF COLORADO <br />DIVISION OF RELCAMATION, MINING AND SAFETY <br />DEPARTMENT OF NATURAL RESOURSES <br />FROM: RIVERSIDE AGGREGATES, LLC <br />1750 COUNTY ROAD HH <br />LAMAR, CO 81052 <br />RE: SHARP PIT #2 File # M- 2013 -023 <br />Preliminary Adequacy Review <br />May 10, 2013 <br />INTRODUCTION: <br />The Division has completed a preliminary review of the permit application and provided comments. <br />The following are written responses to the Division's comments. <br />6.3.1 EXHIBIT A- Legal Description and Location Map <br />1 Map M -1 indicated the names of adjacent property owners of record are shown and labeled, <br />however, the information is not labeled on M -1. <br />RESPONSE: The description has been corrected to read: "THE NAMES OF ADJACENT <br />PROPERTY OWNERS OF RECORD ARE SHOWN AND LABLED ON PAGE M -2 EXHIBIT <br />"A/B, PAGE M -3 EXHIBIT C AND EXHIBIT D <br />2. Please provide a map with the proposed mine site shown on a USGS Topographic <br />quadrangle. <br />RESPONSE: Please see attached USGS Topographic map indicating mining location. <br />6.3.2 EXHIBIT B- Site Description <br />3. Please provide a description of the current vegetation at the proposed site. <br />RESPONSE: The existing vegetation on the proposed site is minimal and includes <br />salt grass, cactus, and prairie grass. <br />4. Center Pivot Sprinkler located with -in 200 feet of the eastern permit boundary. <br />RESPONSE: Please see the attached copy of the Operator /Structure Owner <br />Damage Compensation Agreements. <br />6.3.3 EXHIBIT C- Mining Plan <br />5. The Mining Plan states topsoil will be salvaged at 1" -14 ". Please provide a smaller range of <br />topsoil to be removed. <br />RESPONSE: The corrected range for topsoil removal is 6 " -14" Top soil /growth <br />medium will be removed and salvaged. <br />6.3.4 EXHIBIT D- Reclamation Plan <br />6. On page 4, Exhibit E the application submitted to the Division reads "There are no <br />significant, valuable and permanent man -made structures with -in 200 feet of the affected <br />area. <br />Sharp Pit #2 - DRMS File NO.
