FS Agreement # 13 -MU- 11020400 -028 <br />DNR Agreement # _ <br />B. Cooperating Agency Responsibilities: <br />1. The DNR is a Cooperating Agency in this analysis and is recognized to have <br />jurisdiction bylaw and /or special expertise in the following areas: <br />a) All phases of coal mine permitting, inspection and enforcement. <br />b) Management of fish, wildlife and recreational resources. <br />2. To the extent reasonable and allowable by available resources, the DNR <br />will provide information, comments, and technical expertise to the Forest <br />Service regarding those elements of the analysis, and the data supporting <br />them, in which they have jurisdiction or special expertise, or for which the <br />Forest Service requests their assistance. In particular, the DNR will provide <br />information on the following topics: <br />a) Environmental resources, operation plan, reclamation plan and <br />mitigation of impacts. <br />b) Other such information that is relevant to planning issues or data <br />needs. <br />c) Potential impacts on fish and wildlife and /or roadless area <br />characteristics and ways in which such impacts may be avoided, <br />minimized or mitigated. <br />3. Within the areas of its jurisdiction or special expertise, the Cooperator <br />may participate in any of the following activities: providing guidance on <br />public involvement strategies, identifying data needs, suggesting <br />management actions to resolve planning issues, identifying effects of <br />alternatives, suggesting mitigation measures, working with the Forest <br />Service to draft technical support documents for the analysis, and providing <br />written comments on working drafts of the analysis and supporting <br />documents. (See also Section CA.) <br />C. Responsibilities of the Parties: <br />1. The Parties agree to participate in this analysis process in good faith and <br />make all reasonable efforts to resolve disagreements. <br />2. The Parties agree to comply, to the greatest extent practicable, with the <br />schedule provided as Attachment A, which includes dates for milestones and <br />timeframes for Cooperators' reviews and submissions unless modified by <br />the Forest Service. <br />3. Each Party agrees to fund its own expenses associated with this analysis. <br />4. The Parties agree to carefully consider whether proposed meetings or <br />other activities would waive the Unfunded Mandates Reform Act <br />
