Federal Land Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.) <br />4. Mineral Leasing Act of 1920, as amended by the Federal Coal Leasing <br />Amendments Act of 1976 (30 U.S.C. 181 et seq.), and the Energy Policy Act <br />of 2005 <br />B. Regulations implementing the above authorities: <br />1. Council on Environmental Quality regulations (40 CFR 1501 et seq.) <br />2. Bureau of Land Management coal leasing regulations (43 CFR 3432) <br />C. The authorities for DNR to enter into this MOU include, but are not limited to: <br />1. Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1201 et seq.) <br />2. 30 CFR Part 700 to end <br />3. Colorado Surface Coal Mining Reclamation Act 34 -33 -101 et seq. <br />4. Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />(2 CCR 407 -2) <br />This MOU is an extension of the USDI and USDA MOU for Providing Coordination of <br />Activities Pursuant to the Federal Coal Management Program (1980). <br />IV. Roles and Responsibilities <br />A. Forest Service Responsibilities: <br />1. As lead agency, the Forest Service retains final responsibility for the <br />content of any draft and final analysis documents. The Forest Service's <br />responsibilities include determining the purpose of and need for the <br />analysis, selecting alternatives for analysis, identifying effects of the <br />proposed alternatives, selecting the preferred alternative, and determining <br />appropriate mitigation measures within the applicable legal and regulatory <br />framework. In meeting these responsibilities, the Forest Service will follow <br />all applicable statutory and regulatory requirements. <br />2. To the fullest extent consistent with its responsibilities as lead agency, <br />the Forest Service will consider the comments, recommendations, data, <br />and /or analyses provided by DNR in the analysis process, giving <br />particular consideration to those topics on which the Cooperator is <br />acknowledged to possess jurisdiction by law or special expertise. <br />3. The Forest Service will provide DNR with copies of documents necessary <br />for the analysis relevant to the Cooperator's responsibilities, including <br />technical reports, data, comments received, working drafts related to <br />environmental reviews, and draft and final documents. <br />2 <br />
