The agreement provides for temporary and <br />permanent easements for Metro's benefit to accommodate its construction and operation <br />of a new wastewater treatment plant and associated pipelines (the "Northern Treatment <br />Plant "). <br />In addition to rights granted to Metro related to its sanitary sewer pipeline and associated <br />facilities, the easements grant rights to Metro for riparian and wetland mitigation <br />requirements associated with the overall Northern Treatment Plant project as well as for <br />reclamation to be performed by Metro on behalf of Al per the above - referenced <br />agreement. The mitigation and reclamation provisions result in minor changes to the <br />currently approved reclamation of the area generally referred to in the permit documents <br />as the North Lake. Based upon our February 14 discussion, you advised that a request for <br />technical revision should be submitted to address these reclamation revisions within the <br />approximate 54 acre parcel (Metro's seeding/mitigation areas total 35.86 acres, which <br />encompasses the North Lake area. <br />Amendment 1 of the permit proposed post- mining land use of the Brighton Mine for one <br />unlined pond on the north and two water storage reservoirs (referred to as the Central <br />Reservoir and South Reservoir) with surrounding wildlife habitat. Amendment 2 of the <br />permit proposed to minimize the surface area of the approximate 36 -acre unlined pond by <br />backfilling approximately 15 acres of the pond and creating wetlands.
