SJ <br />mny Seneca Coal Company <br />February 22, 2013 <br />Dennis and Laurie Hallenbeck <br />36190 County Road 27 <br />Hayden, CO 81639 <br />RE: Yoast Mine Permit No. C- 1994 -082 <br />Postmining Land Use Change at Round -About Area <br />Dennis and Laurie Hallenbeck, <br />Seneca Coal Company (SCC) is requesting a land use change on 6.25 acres associated with <br />the west side of the round -about on Rd. 27. As you know this area was a portion of the Yoast <br />permit area that was used as the dragline deadhead route from Seneca II mine to Yoast Mine. <br />Prior to the decision to construct the round - about, the area had an approved land use of <br />grazing/wildlife habitat and SCC had reclaimed the area accordingly. Now that the area has <br />been re- disturbed by entities other than Seneca Coal Co, SCC no longer has control or <br />responsibility for the area and is starting the process to remove the area from the Yoast <br />permit boundary. <br />This is a three -step process: <br />1. A technical revision will be submitted by Seneca to the State for approval to change <br />the current land use of the area from grazing/wildlife habitat to <br />industrial/commercial; <br />2. A bond release application will then be submitted by Seneca to the State requesting <br />approval to release SCC from any further reclamation liability; and <br />3. Finally, a technical revision will be submitted to the State for approval to remove the <br />area from the Yoast permit boundary. <br />The Colorado Division of Reclamation, Mining and Safety (DRMS) is requiring that SCC <br />submit this letter as documentation that the you are aware of the proposed land use change <br />and is in agreement with the change. <br />By signing below, this letter will serve as the documentation that you, as the landowner, are <br />aware of and are in agreement with the proposed land use change. <br />Dennis and/or Laurie Hallenbeck Date <br />Seneca Coal Company .
