Pineda <br />Director <br />The Division has completed a preliminary adequacy review of the technical revision application <br />(TR -78) submitted by Bowie Resources, LLC (BRL) for the Bowie No. 2 Mine. The revision <br />proposes the installation of six gob vent boreholes and one exploration hole. We have the <br />following comments and questions regarding the application. <br />1. BRL indicates, in the cover letter for the revision (dated April 10, 2013), that a surface <br />agreement with Derby Mountain, LLLP should be reached in the next 30 days. To date, <br />the Division has not received a copy of this surface agreement. The Division cannot <br />approve this revision until BRL provides the right of entry information required under Rule <br />2.03.6. Please provide right of entry documentation for the proposed disturbance on <br />land owned by Derby Mountain, LLLP. <br />2. The proposed exploration hole SS -8 is within the C -37210 lease modification area <br />approved by the Division PR -13, and awaiting mine plan approval by the Office of <br />Surface Mining (OSM). Upon approval of TR78, the Division will stipulate that SS -8 <br />cannot be drilled until the mine plan proposed under PR13 has been approved by OSM. <br />3. Jim Stover, in an email dated May 1, 2013, requested that TR78 be used as a means for <br />the inclusion of two monitoring wells (2010 -1B and 2010 -1SS) in the Bowie No. 2 Mine <br />Permit. These wells were previously permitted under NOI 2005 - 217 -10. The inclusion <br />of these wells will change the proposed disturbed acreage and proposed affected <br />acreage initially proposed in the TR78 application. The Division estimates that the <br />Disturbed Area increase with TR78 will now be 14.34 acres, and the Affected Area <br />acreage increase will be 2.0 acres. <br />4. The Division has previously forwarded (electronically) our estimate of the reclamation <br />costs associated with the disturbance proposed in TR78.
