Mr. Lockard <br />Page 13 <br />May 14, 2013 <br />6.4.5 Exhibit E — Reclamation Plan <br />13. The Applicant has stated a berm will be constructed along the bank of Surveyor Creek to <br />control stormwater runoff. Please confirm that the berm will be removed during final <br />reclamation of the site. <br />6.4.6 Exhibit F — Reclamation Plan Map <br />14. The scale on the Reclamation Plan Map is 1 inch = 800 ft. As required by Rule 6.2.1(2)(e), <br />the scale is to be no smaller than 1 inch = 660 ft. Please revise the Reclamation Plan Map <br />accordingly. <br />15. The contour lines on the Reclamation Plan Map do not depict the final grade of the reclaimed <br />area. Please revise the Reclamation Plan Map to show the final grade of the reclaimed area; <br />you may use arrows and text to indicate the direction and rate of slope. <br />16. As required by Rule 6.2.1(2)(d), please label the permit boundary for both the existing and <br />proposed areas. <br />6.4.19 Exhibit S — Permanent Man -made Structures <br />17. The Applicant has identified Highway 34 and the Burlington Northern Railroad as structures <br />that are within 200 feet of the affected area. The Applicant will need to submit the <br />appropriate structure agreements for these structures as required by Rule 6.4.19. If an <br />agreement with the structure owner cannot be reached, then the Applicant shall provide an <br />appropriate engineering analysis that demonstrates that such structures shall not be damaged <br />by activities occurring at the mining operation. Please respond. <br />As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies <br />prior to June 12, 2013, it will be your responsibility to request an extension of time to allow <br />for continued review of this application.
