Mr. Lockard <br />Page 12 <br />May 14, 2013 <br />6.4.3 Exhibit C — Pre - Mining and Mining Plan Map(s) of Affected Lands <br />3. The Applicant has included a scale on the Mining Plan Map; however, the scale bar does not <br />clearly illustrate the scale used. Please specify the scale which was used on the Mining Plan <br />Map. <br />4. The Applicant has stated that Marilyn Elrick owns all adjoining surface areas around the <br />Elrick Pit. Please specify if this applies to both the existing permit area as well as the <br />proposed permit area. <br />5. The Mining Plan Map depicts a stockpile on the north perimeter of the proposed amended <br />area. Is this a product stockpile or a topsoil stockpile? Please label the stockpile accordingly. <br />6. Please revise the Mining Plan Map to include the location of the topsoil stockpile. See <br />additional comments under Exhibit D, No. 11. <br />7. The Applicant has stated the proposed amended area will be accessed from the existing site <br />entrance on County Road 40. In addition, the Applicant has stated the site will be accessed <br />from the north near the parking area. In order to clarify how the site will be accessed, please <br />depict the haul route on the Mining Plan Map. <br />8. The Applicant has stated a berm will be placed along the banks of Surveyor Creek. Please <br />depict the location of the berm on the Mining Plan Map. <br />6.4.4 Exhibit D — Mining Plan <br />9. As required by Rule 6.4.4(f), please specify the depth to which the proposed amended area <br />will be mined. <br />10. The Applicant has stated the topsoil stockpile will be stabilized with vegetation established <br />through natural seeding. The topsoil does contain a seed bank which includes grass species. <br />However, the seed bank will likely yield annual weeds rather than grasses. The Operator <br />should seed the topsoil stockpile with a grass species that is a part of the approved seed mix. <br />Please respond. <br />11. The Applicant has stated that topsoil will be stockpiled along the bank of Surveyor Creek. <br />The topsoil should be stockpiled in a location where it will not be susceptible to erosion due <br />flooding of Surveyor Creek. The Division recommends placing the topsoil stockpile along <br />the northern perimeter of the proposed amended area. Please respond. <br />12. The Applicant has not specified if there will be a buffer between the east end of the proposed <br />amended area and Surveyor Creek. The Division recommends leaving a buffer of 100 ft. <br />along the east end of the proposed amended area. Please respond. <br />
