Applicant Response: The longitude was misstated as —140° 51' 17.034"
which is a typographical error the longitude is —104° 51' 17.034 ". However,
Mr. Mike Trujillo did inspect the correct site as evidenced in is letter on
dated April 30, 2013, Mr. Trujillo stated in the letter that the permit area he
inspected was adjacent to the HIBAR PIT M- 2009 -027, which is west of the
Orphan View Gravel Pit. Below is the paragraph of the letter in which Mr.
Trujillo states his assertion:
After visiting the site it appears that the current use of this land is for gn".ing of livestock,
and is composed mainly of short grass prairie. The IIRI13AR PIT- M -2009 -027 adjoins
the property on the western boundary and is being operated by Walsenburg Sand and
Gravel. Irrigated pastures and a riparian corridor from the Huerfano River are located to
the north of the proposed Orphan View Gravel Pit.
6.4.10 EXHIBIT J — Vegetation Information
9. The post mine land use is stated to be rangeland. Rule 6.4.10(1)(c)
requires "estimates of average annual production for hay meadows and
croplands, and carrying capacity for range lands on or in the vicinity of
the affected land, if the choice of reclamation is for range or agriculture ".
The Division could not find the carrying capacity for range lands in
Exhibit I or J. Please provide this information.
Applicant Response: The post mine land use will be rangeland. The
estimated average annual production was not in the Natural Resources
Conservation Service (MRCS) report, however the applicant phoned Mr. Tony
W. Arnhold District Conservationist on May 9, 2013 to obtain the
information. He analyzed the map and discerned the portions that will be
reclaimed and gave his professional opinion. Mr. Arnhold was very helpful
and he reviewed the file and emailed the Rangeland Productivity sheet. We
have enclosed the Rangeland Productivity sheet for your file. The average is
based on three conditions- favorable year, normal year and an unfavorable
year. The low was 400 pounds per year to 1500 pounds per year, please see
NRCS page I of 1 attached to this report.
