Applicant Response: The discrepancy between the 40 acres shown on the submitted <br />application and the 31 acres stated on Exhibits A, B, C and F are due to the changes made <br />to the change of the permit boundary after the permit application was prepared. <br />4. Exhibit C, Mining Map — The Phase 1 boundary includes a portion of the <br />San Isabel Electric Association's (SIEA) overhead power line. As a result <br />of discussions during the April 30, 2013 inspection, the Division <br />understood there was no planned excavation near the power line. This is <br />not evident from a review of the Mining Map. Please clarify the <br />Division's understanding, and if no mining excavation is planned in this <br />area, indicate as much on the Mining Map. <br />Applicant Response: No mining excavation is planned in this area, only <br />earthwork to clear a area suitable for crushing and screening plant and <br />ancillary equipment necessary for processing the raw materials. The earth <br />work will also level an area for product stockpiles. <br />6.4.4 EXHIBIT D — Mining Plan <br />5. 21 page, paragraph (e)(i) —There is a discrepancy with respect to the <br />estimated periods of time: "... which is stated above of ten (5) years per <br />phase, ... ". Please clarify whether the estimated time frame is five (5) or <br />ten (10) years. <br />Applicant Response: The discrepancy shown above in regard to the <br />"... estimated periods of time which stated ten (5) years per phase... <br />contains a typographical error, it should read the estimated periods of time <br />which stated five (S ) years per phase... ". The applicant is stating the time <br />frame of five (5) years per phase is the best estimate based upon the demand <br />in the area for road maintenance gravel. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />6. Section 3.1.8 Wildlife — There is a reference to a statement made by "Mr. <br />Gallegos ". Michael Trujillo signed the referenced letter. Who is Mr. <br />Gallegos and how does he represent Colorado Parks and Wildlife (CPW)? <br />Applicant Response: The reference to "Mr. Gallegos" is incorrect. The Area <br />Wildlife Manager with the Department of Parks and Wildlife in this part of <br />Colorado is " Mr. Mike Trujillo" with his office address of 600 Pueblo <br />Reservoir Road Pueblo, CO 81005 phone number (719) 561 -5300. Please <br />accept the authors apologize for the mistake. Mike Trujillo is the correct <br />person that should be mentioned in the application narrative. <br />
