Preliminary Adequacy Review
Dear Mr. Friederichs:
The Division has completed a preliminary review of the permit application, and has the following
comments:
6.3.1 EXHIBIT A - Legal Description and Location Map
1. Map M -1 reads "The names of adjacent property owners of record are shown and labeled ",
however this information is not labeled on M -1. Please either clarify this statement or provide
information as to where the property ownership information is located.
2. Please provide a map with the proposed mine site shown on a USGS topographic quadrangle.
6.3.2 EXHIBIT B - Site Description
3. Please provide a description of the current vegetation at the proposed site.
4. The map provided shows a center pivot sprinkler is located within 200 feet of the eastern
proposed permit boundary. The sprinkler is a permanent man -made structure. (Examples of
permanent structures are: buildings, houses, barns, fences, above or below ground utilities,
irrigation ditches, maintained or public roads, bridges, railroad tracks, cemeteries,
communication antennas, pipelines, water wells, water storage structures, discharge and
conveyance structures.) Please provide either a copy of an operator /structure owner damage
compensation agreement, or if such an agreement cannot be reached, provide an engineering
evaluation that demonstrates the fence will not be damaged by activities at the mine.
6.3.3 EXHIBIT C - Mining Plan
5. The mining plan states topsoil will be salvaged at 1" -14 ". Please provide a smaller range of
topsoil to be removed, or please provide information to justify salvaging 1 " -14 ". The Division
believes that 6 " -14" of topsoil /growth medium would be a more suitable range to be salvaged.
