Response to DRMS Adequacy Review (1) — Cotter JD -9 Mine Reclamation Plan Amendment <br />Cotter Corporation (N. S.L.) ( "Cotter ") submits this response to the January 30, 2013 letter from <br />Travis Marshall, Division of Reclamation, Mining and Safety ( "DRMS "), to Glen Williams, <br />Cotter. The DRMS' comments are in italics and Cotter's responses are in bold. <br />Exhibit A <br />1. The application form, introduction of the application and Exhibit A state that a reduction <br />of 1.69 acres will be released as part of this amendment. Per Rule 4.17(3), The written <br />notice requesting release shall be sent by certified mail and be separate from other types <br />of communication. Therefore the release request cannot be considered at this time and <br />the proposed permit acreage is 28.46 acres. <br />It was an oversight of Cotter's to include a request to release acreage in this <br />amendment. A release of 1.74 acres northwest of the southern permit area had <br />already been approved in a 1994 amendment. Based on recent drawings of the <br />permit boundary, Cotter estimated this area to be 1.69 acres. The actual acreage <br />that was released was 1.74. The 1994 amendment is included in Attachment 1. <br />A revised Exhibit A, introduction of the application and pages 1, 5, 7 and 8 of the <br />application form are also included in Attachment 1. The total acreage to be <br />permitted in this amendment is 26.72 acres. <br />Exhibit C <br />2. Due to the acreage release not being associated with this amendment please provide a <br />revised Figure C4 2 of 2 that shows the entire permit area without the 1.69 acres <br />removed <br />A revised Figure C4 is included as Attachment 2. <br />3. Please provide two copies of Mine Plan maps that identify the current and proposed <br />waste rock pile configuration. All mine plan maps submitted do not clearly identify the <br />waste rock pile. <br />A revised Figures C1, C2 and C3 are included as Attachment 3. <br />
