G -2 WATER REQUIP NTS AND SOURCE (cont'd) <br />through Water District No. 20, Civil Action No. 3792, court proceedings. <br />The half- second foot has proven more than adequate for all mine and plant <br />requirements. <br />The Creede diversion point and pipeline is not included in the <br />permit areas. No access roads are present and the pipeline is buried. All <br />surface disturbance has been reclaimed and easements through private prop- <br />erty were obtained prior to construction. Minor maintenance is required <br />but any surface disturbance is immediately restored. <br />G -3 SURFACE AND GROUND WATER SYSTEMS AFFECTED BY MINING <br />Current mining and milling operations have not caused injury to <br />downstream users and are not expected to do so in the future. Diversion <br />ditches have been constructed to prevent runoff from entering tailings <br />impoundment areas and all construction and disturbed sites where runoff <br />could produce erosion have been revegetated to prevent degradation of sur- <br />face and subsurface water quality. <br />Underground mine operations may have intersected drainage of the <br />nearby Emperius Mine, causing a diversion of that mine's non - tributary water <br />decree. As a consequence, Homestake Mining Company entered into a legal con- <br />tract with Kanawha Mines and Emperius Mining Company whereby all waters en- <br />countered on certain levels of Homestake's mine operation would be pumped <br />to the surface and discharged at a specific location designated. This re- <br />quirement has been met and the legal agreement fulfilled with no net loss <br />of water to the Emperius Mining Company. <br />
