April 23, 2013 <br />Via Email and Certified Mail #: 7006 2150 0001 8831 9452 <br />Mr. Peter Hays <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203 <br />Re: Follow -up Notice for Mill Tailing Delivery Line Leak, Drop Tower 7, Permit No. M- 1977 -342 <br />Dear Mr. Hays: <br />Henderson Mill is providing this written follow -up notice to a phone call made to you on April 17, 2013 <br />pursuant to Rule 8.1 and 8.2 of the DRMS Rules and Regulations. <br />This notice is regarding tailing slurry which escaped through a previously repaired area between two <br />joints of reinforced concrete piping (RCP) associated with the Tailing Delivery Line (TDL), which occurred <br />April 16, 2013 at approximately 5:20pm. The TDL is considered an environmental protection facility with <br />the Mill Process Water System, in Henderson Mill's Environmental Protection Plan. The leak was <br />discovered at 5:20pm, at which point, an estimated volume between 700 -800 gallons of tailing material <br />leaked onto the ground. <br />(a) <br />(b) <br />(c) <br />Climax Molybdenum <br />A Freeport - McMoRan Company <br />After discovering the issue, Henderson employees promptly diverted flow from the tailing <br />delivery line to the emergency cutout line, which curtailed the flow of further flow from the <br />breach. <br />Mill tailing slurry flow did not adversely impact human health, property or the <br />environment. The entirety of the slurry that leaked from the TDL made its way along the <br />TDL alignment.
