Pineda <br />Director <br />The Division has completed a preliminary adequacy review of the technical revision application <br />(TR -77) submitted by Bowie Resources, LLC (BRL) for the Bowie No. 2 Mine. The revision <br />proposes the use of overburden materials as a substitute for topsoil in the Gob Pile #2 area. <br />We have the following comments and questions regarding the application. <br />1. Revised page 2.04 -101 submitted with TR -77 indicates that select overburden materials <br />may be used as a replacement and or supplement for the topsoil on the coal mine waste <br />piles. The language used should be updated to specify "coverfill material" may be used as <br />a supplement to the topsoil material as this is the only type of overburden material that <br />was evaluated and considered for this use. The use of other types of overburden material <br />as a replacement and or a supplement to topsoil would require a separate analysis with <br />the justification and test results submitted to the Division for approval in accordance with <br />Rule 4.06.2(4). Please revise Page 2.04 -101 to clarify that "coverfill materiaP' is the only <br />material that will be used as a topsoil supplement. <br />2. The first sentence of item (3) on revised Page 2.04 -101, should be updated to clarify that <br />the coverfill material will only be used to "supplement" the available topsoil material to <br />be replaced. The coverfill material should only be considered as a replacement to the <br />topsoil that was not salvageable in accordance with the variance approved in TR -76. <br />Please revise Item 3 of page 2.04 -101 to clarify that coverfill material will be used to <br />supplement available topsoil when topsoil is not available for salvage, and not as a <br />general replacement for topsoil. <br />3. The first sentence of item (3) on revised Page 2.04 -101 should specify that coverfill <br />material will be used to supplement the topsoil to be replaced on the gob pile #2/4 area <br />where the topsoil deficiency exists. The submitted revised page broadly states that <br />substitute material will be utilized on coal mine waste piles and this material may not be <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
