CRITERIA FOR BOND RELEASE <br />Phase I Bond Release <br />Section 3.03.1(2)(a) of the Boards Regulations states, "Up to sixty percent of the applicable <br />bond amount shall be released when the permittee successfully completes backfilling, <br />regrading, and drainage control in accordance with the approved reclamation plan." <br />Items Approved for Permanent Retention <br />Three sediment ponds are approved to remain as permanent: Moffat Pond, Center Ridge <br />Pond and West Ridge Pond. The approved permanent rip- rapped drainages include: <br />The Center -West Ridge drainage channel (Chain of Pearls); <br />Moffat Down Drains 1, 2, 3, 4 and the Moffat Final Pit down drain; <br />Collection Ditches at the Moffat Pond area; <br />West Ridge Pond to Center Ridge Pond diversion ditch; <br />West Ridge Pond collection ditch; and <br />Fourteen West Ridge terraces diverting to the Center -West Ridge drainage. <br />Roads and culverts within the lands requested for release include the North Road, Skyline <br />Drive, West Ridge Pond Road, Center Ridge Pond Road, Lower Moffat Area Pond Road, <br />and roads associated with permanent ponds. All roads within the land requested for release <br />have been previously approved for permanent retention. <br />Phase II Bond Release <br />Section 3.03.1(2)(b) states, "Up to eighty -five percent of the applicable bond amount shall be <br />released upon the establishment of vegetation which supports the approved postmining land <br />use and which meets the approved success standard for cover based on statistically valid data <br />collected during a single year of the liability period ". In regard to Phase 11 bond release, <br />Section 3.03.1(3)(b) also states, "No more than (60) percent of the bond shall be released so <br />long as the lands to which the release would be applicable are contributing suspended solids <br />to streamflow or runoff outside the permit area in excess of premining levels as determined <br />by baseline data or in excess of levels determined on adjacent non -mined areas ". <br />Topsoil <br />Portions of the Moffat Area and the West Ridge Area were reclaimed with material other than <br />topsoil. These areas were disturbed prior to the initiation of the State of Colorado's Permanent <br />Coal program on December 15, 1980 (45 FR 82173), and prior to the subsequent promulgation <br />of the Board's regulations (first effective August 30, 198 1) requiring topsoil salvage, storage <br />Edna Mine Page 10 April 12, 2013 <br />Phase II. and III Bond Release <br />
