Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
RECEIVED
`APR 1 12013
Division of Reclamatio
Mining & Safety
We have reviewed your letter dated February 15, 2013, requesting renewal of the above
referenced substitute water supply plan to cover depletions caused by an existing mining
operation. The required fee of $257.00 for the renewal of this substitute supply plan has been
submitted (receipt no. 3654109). The original supply plan was approved on December 3, 2001
and was most recently renewed on July 30, 2012 for operations through March 31, 2013.
Plan Operation
This plan seeks to replace depletions resulting from mining operations at the Hokestra
gravel pit (well permit no. 63693 -F), owned and operated by Weld County ( "County "). The
County does not intend to operate the Hokestra Pit for mining during this SWSP period,
therefore the only depletions at the site during this SWSP period will be evaporation from
exposed ground water and water used for irrigation at Weld County's Southwest Service Center.
The proposed replacement sources are 3.75 Rural Ditch shares owned by Weld County and
storage of excess credits from those shares in Varra Companies' lined 112 Reservoir (WDID
0504001),
In accordance with the letter dated April 30, 2010 from the Colorado Division of
Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply
with the requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations
for the protection of water resources. The April 30, 2010 letter from DRMS requires that you
provide information to DRMS to demonstrate you can replace long term injurious stream
depletions that result from mining related exposure of ground water. Pursuant to approach
number 3, the County is completing a slurry wall to eliminate the long term evaporation from the
site. No bond has been posted for this work because a financial warranty is not required for a
county. Further the County will pursue an augmentation plan for the remaining unlined areas
using their 3.5 Rural Ditch shares.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.water.state.co.us
