Stipulations that have been <br />added to the permit during previous permitting actions that have not been terminated remain <br />attached to the permit. <br />3.1.5 Status of Permit Renewal <br />The Division received CCC's application for Permit Renewal No. 6 (RN -6) on March 12, 2012. <br />RN -6 application was found complete on March 16, 2012. The Division sent CCC adequacy <br />letters identifying concerns on May 15, 2012, October 3, 2012, November 2, 2012, and <br />December 19, 2012. CCC provided responses to the Division's adequacy concerns on July 30, <br />2012, August 17, 2012, October 25, 2012, November 9, 2012, December 13, 2012, December <br />31, 2012, January 7, 2013, January 14, 2013. The Division issued a proposed decision to <br />approve RN -6 with conditions on April 5, 2013. <br />3.1.5 Status of Bond Releases <br />This section identifies Bond Releases (SL) processed since the findings of Permit Renewal No. <br />5, September 14, 2009. <br />SL -4: Bond Release application No. 4 was submitted to the Division on June 1, 2010. SL -4 was <br />found complete on August 12, 2010. SL -4 requested partial Phase I and II bond release on <br />portions of the East Pit, West Pit and Section 16 Pit consisting of 494.20 acres requested for <br />Phase I and 420.90 acres requested for Phase II bond release. SL -4 bond release included lands <br />reclaimed between 1993 and 2003 in the East Pit, West Pit and Section 16 Pit. Colowyo <br />requested the release of $2,585,974.00 for the Phase II areas for topsoil replacement and <br />reestablishment of vegetation. SL -4 was partially approved on May 2, 2011. 11.8 acres <br />originally requested for Phase II bond release were removed from Phase II release due to <br />excessive annual vegetative species. <br />SL -5: Bond Release application No. 5 was submitted to the Division on June 28, 2010. SL -5 <br />was found complete on August 12, 2010. SL -5 requested partial Phase III bond release for <br />portions of the East Pit, West Pit consisting of 979.5 acres. SL -5 bond release included lands <br />reclaimed between 1978 and 1999 in the East Pit and West Pit. Colowyo requested the release of <br />$5,000,000.00 for the Phase III areas for the successful completion of all reclamation operations <br />in accordance with the approved reclamation plan. All lands requested for Phase III bond release <br />in SL -5 had previously been approved for Phase I (SL -1) and Phase II (SL -3) bond release. <br />The Division approved Phase III bond release on 979.5 acres on July 25, 2012. The Division <br />released $692,320.00 of the reclamation bond for successful reclamation of 979.5 acres included <br />in the SL -5 application. <br />SL -6: Bond Release application No. 6 was received by the Division on April 26, 2012. SL -6 <br />was found complete on July 16, 2012. The SL -6 application requests Phase I bond release of <br />Colowyo Coal Mine C1981 -019 PR -03 14 April 10, 2013 <br />
