SUBMITTAL OF THE ASSOCIATED FIGURES, TEXT, AND EXHIBITS FOR SEDCAD <br />RUNS. <br />STIPULATION 16: <br />IN ACCORDANCE WITH A RECOMMENDATION BY USFWS (BIOLOGIC OPINION <br />DATED OCTOBER 30, 2012), COLOWYO IS REQUIRED TO MARK WIRE FENCING <br />NEAR AREAS OF HIGH GROUSE USAGE IN CONSULTATION WITH COLORADO <br />DIVISION OF PARKS AND WILDLIFE. <br />STIPULATION 17: <br />THE OPERATOR SHALL SUBMIT AS MINOR REVISIONS TO THE PERMIT THE <br />FINDINGS OF ARCHAEOLOGIC REPORTS AS REQUIRED BY PR3 PERMIT <br />COMMITMENTS IN EXHIBIT 5, INTO THE PERMIT FOR INCLUSION INTO EXHIBIT 5 <br />(THE CULTURAL RESOURCES INVENTORY). <br />This Decision is based on a finding that the operations will comply with all requirements of the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34 -33 -101 et seq., and the Rules <br />promulgated pursuant to the Act. Public notice of this proposed Decision will be published for <br />two consecutive weeks in the Craig Daily Press. If no request for a formal hearing is made <br />within thirty (30) days of the first publication of the public notice of this proposed Decision, then <br />this Decision becomes final. The Division and Colowyo have come to an agreement of the <br />amount of the reclamation bond to be posted as a result of PR -03. Upon the issuance of this <br />decision Colowyo will submit the appropriate bond monies. The Application and all supporting <br />documentation and any stipulations or conditions will become a binding part of the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary <br />of the Interior has approved the proposed mining plan. <br />3. Summary <br />3.1 History of the Review Process <br />3. 1.1 Revision Description, Initiation and Progression of the Revision <br />Permit Revision 3 (PR -03) was submitted by the Colowyo Coal Company to permit two multi - <br />seam coal mining pits in the Collom Creek drainage area: the Little Collom X Pit and the Collom <br />Lite Pit. PR -03 increases the permit area from 12,250.95 acres to 29,075.74 total acres. Of the <br />16,824.79 acre increase, 2,525.18 acres are federally owned surface, 13,662.61 acres are <br />privately owned surface, and 637.0 acres are State owned surface. Additionally, the 16,824.79 <br />acre increase includes an increase of 14,376.48 acres of federally owned mineral rights, 1,811.31 <br />acres of privately owned mineral rights, and 637.0 State owned mineral rights.
