4 - .. <br />Item 6 states "Name of owner of subsurface rights of affected land" is said to be the estate of <br />Joseph W. Cook. It appears at some point the estate of Joseph W. Cook became the owner of <br />the Smith lands described upon section 32 of this proposal to mine. In any case the United States <br />still retains ownership to the oil & gas subsurface estate beneath these lands. Currently, there are <br />no oil & gas leases on the application area, however we wanted to make you aware that it could <br />be leased in the future. <br />In the proposal it identified and documented numerous occurrences of a United States Fish and <br />Wildlife Service threatened plant species Sclerocatus glaucus, more commonly known as <br />Colorado Hookless Cactus. We note that Delta County has contracted to have the endangered <br />cactii transplanted as a part of the included mitigation plan. <br />We appreciate the opportunity to comment on projects of this nature.
