SW' /4 SE' /4 Section 28 <br />E' /z NW' /4 Section 33 <br />W' /z SW' /4 Section 33 <br />The additional study data will be forwarded to the Office of Archaeology & Historic Preservation <br />(within History Colorado) for their evaluation and a determination of the proper course of action <br />required. <br />Stipulation 7 <br />The Colowyo Coal Company shall submit a Technical Revision (TR) to the Division which <br />provides an analysis of groundwater points of compliance at the Colowyo Mine pursuant to Rule <br />4.05.13(1). This analysis will be done in consultation with the Division and will include a <br />written determination of the need for groundwater points of compliance at the mine. If deemed <br />appropriate, based on this analysis, Colowyo shall establish one or more points of compliance for <br />the Colowyo Mine. <br />Stipulation 10 <br />Prior to disturbing any lands along Wilson Creek, the Colowyo Coal Company shall provide the <br />Division with a detailed analysis and discussion of the alluvial valley floor (AVF) that has been <br />documented in the area. Colowyo must also provide a detailed plan for the restoration of the <br />AVF if and when it is disturbed. This analysis may be in the form of a stand -alone revision or it <br />may be contained in the revision required in Stipulation 3. Any revision submitted must be <br />approved by the Division prior to any disturbance. <br />Stipulation 14 <br />Within 45 days after final approval of RN -06, unless Colowyo adds a rider to their bond of <br />$25,800,159.00, Colowyo will provide a complete MR that contains a cumulative bond schedule <br />for the Colowyo Mine. The minor revision will include (at a minimum) permit text, an appendix <br />containing the cumulative bond schedule to be included in Exhibit 13a, and the following <br />information: <br />• Current East and West Taylor temporary fill volumes <br />• Current South Taylor Pit elevation (pit floor elevation) and a map or plate showing this <br />• Final South Taylor Pit floor elevation (also shown on map or plate) <br />• Remaining South Taylor Pit elevation <br />• Remaining South Taylor Pit volume (this will be the current volume to be removed, not <br />the anticipated volume based on the planned mine plan change) <br />• Remaining West Pit spoil pile peak volume <br />• Current West Pit spoil pile elevation <br />• A schedule that shows remaining pit depth and volume broken down into appropriate <br />increments <br />Proposed Decision and Findings of Compliance January 2012 <br />Permit Renewal 06 Pa g e 14 <br />
