2. Proposed Decision <br />The Division proposes to Approve with Conditions an application for renewal (Permit Renewal <br />6) of a valid existing permit (C- 1981 -019) to conduct surface mining and reclamation activities <br />in Colorado. <br />The following stipulations were complied with since RN -05 approval on September 14, 2009: <br />Stipulation 12 and Stipulation 13. <br />The following stipulations are a binding part of the Permit. Stipulation 14 has been added as <br />part of the renewal process. <br />Stipulation 2 <br />Prior to disturbing any lands in the Lower Wilson area, the Colowyo Coal Company shall <br />provide the Division with a permit revision containing a mine plan and a reclamation plan and <br />any additional baseline monitoring information (surface water, ground water, soils, vegetation, <br />etc.) requested by the Division. The approval of Permit Revision 02 is only an approval for <br />disturbance in the South Taylor Pit (South Taylor Pit, West Valley Fill, East Valley Fill and <br />associated structures). No disturbance is approved for the Lower Wilson area with the approval <br />of Permit Revision 2. <br />Stipulation 3 <br />Prior to disturbing the Lower Wilson area, the Colowyo Coal Company shall perform further <br />archaeological investigations on seven areas identified as requiring more detailed study in the <br />October 1984 report titled "Cultural Resources Investigations in the Danforth Hills Proposed <br />Coal Lease Area, Moffat and Rio Blanco Counties, Colorado," Nickens and Associates, <br />sponsored by Consolidation Coal Company. These areas are as follows: 5MF1652, 5MF1935, <br />51\AF1937, 5MF4003, 5MF4010, 5MF4011, and the bison bone in the cut -bank. The additional <br />study data will be forwarded to the Office of Archaeology & Historic Preservation (within History <br />Colorado) for their evaluation and a determination of the proper course of action required. <br />Stipulation 4 <br />Prior to disturbing the Lower Wilson area, the Colowyo Coal Company shall perform further <br />archaeological investigations on the six areas identified on Map 16A as "unsurveyed areas." <br />Additionally, Colowyo will be required to survey any other areas that are determined to have no <br />survey or inadequate survey data.
