H. Transfer of Wells - Rule 4.05.14 <br />No transfer of wells is proposed. All monitoring wells will be reclaimed prior to bond release. <br />L Water Rights and Replacement - Rule 4.05.15 <br />Colowyo has demonstrated that no owner of a vested water right is proximately injured. <br />J. Discharge of Water into an Underground Mine - Rule 4.05.16 <br />In Colowyo's operations plan, no surface water will be discharged into underground mine <br />workings. <br />K. Stream Buffer Zones - Rule 4.05.18 <br />The Division approved surface or underground mining activities within 100 feet or through a <br />perennial stream or stream with an aquatic community. This decision was based on a finding <br />that the original stream channel will be restored, water quality and quantity shall not be adversely <br />affected, and appropriate riparian vegetation will be reestablished. The buffer zone variance is <br />granted for portions of Good Spring Creek near the sediment ponds which discharge into that <br />creek (Streeter Pond, Gulch A Pond and Prospect Pond), and that portion of Taylor Creek near <br />the loadout. <br />Regarding the West Fork of Good Spring Creek, the Division approved the use of an access road <br />(Sturgeon Road, which was a ranch road prior to mining) that is within 100 feet of the creek for a <br />short distance. However, most of the length of the road is more than 100 feet from the centerline <br />of the creek (per Map 25B in PAP). Furthermore, the probable hydrologic consequences (PHC) <br />section in the PAP does not indicate that the road will impact water quality in this creek. <br />L. Probable Hydrologic Consequences <br />A discussion of the probable hydrologic consequences of mining and reclamation operations is <br />contained in Section 2.04.7 of the PAP. The original findings document (1982), an Amended <br />Findings Document for Permit Renewal (1987), and TR -14 (1989) also include discussions of <br />probable hydrologic consequences. Probable Hydrologic Consequences for the South Taylor <br />area are included in Section 2.05.6 in Volume 12 of the PAP. <br />Potential Effects on Surface Water Quantity <br />The Mine will have very limited regional impacts on surface water. This assessment is based on <br />hydrologic reports from the 1970s and 1980s, the PHC section of the PAP, and past Division <br />Proposed Decision and Findings of Compliance January 2012 <br />Permit Renewal 06 Page 135 <br />
