Designs for these ponds are included in Exhibit 7 and the locations of the ponds are shown <br />on Maps 12, 12A, 41 and 41A. <br />Sediment ponds and stocktanks at the Mine have been determined to be environmentally sound <br />and structurally stable (Rule 4.05.6(11)). <br />E. Acid - forming and Toxic - forming Spoil - Rule 4.05.8 <br />No significant acid - forming spoil exists within the overburden or coal seams to be mined (PAP, <br />Section 2.05.4). This determination has been supported with ongoing soil sampling, including <br />drilling in the South Taylor Pit area associated with PR -02. Overburden sampling and regraded <br />spoil sampling plans are discussed in Section 2.05 of the PAP and Exhibit 6, Item 4. Results <br />from past sampling are included in the Annual Reclamation Reports. <br />No evidence of toxic effects to vegetation on reclaimed areas has been reported to date on the <br />mine site. <br />F. Impoundments - Rule 4.05.9 <br />Design, construction, and maintenance of impoundments at the Mine meet the requirements of <br />Rule 4.05.9. These include: <br />• Sediment ponds (see discussion above) <br />• Stock ponds for watering of cattle and wildlife (see Exhibit 7, Item 15) <br />• Water treatment basins <br />• The Taylor Pump Holding Pond (which existed prior to August 3, 1977). <br />In recent years, stock ponds were added to the reclamation plan. Five of these were added with <br />TR -87 (approved March 2011), and eight stock ponds were added to the plan with TR -89 (also <br />approved March 2011). These have been constructed, and locations are shown on Map 12 of the <br />PAP. <br />G. Ground and Surface Water Monitoring - Rule 4.05.13 <br />The surface and ground water monitoring plan is in Section 4.05.13 of the PAP, and results are <br />reported in quarterly Discharge Monitoring Reports and Annual Hydrology Reports. <br />Monitoring includes discharges from sediment ponds, a requirement of Colowyo's CDPS permit <br />with the Water Quality Control Division (a division within CDPHE). It also includes in- stream <br />monitoring and sampling of streams in the permit and adjacent area, monitoring and sampling of <br />alluvial wells, and monitoring of water levels in wells (piezometers) on fills. <br />Proposed Decision and Findings of Compliance January 2012 <br />Permit Renewal 06 Page 134 <br />
