Page 2 of 3 <br />Pine Bluffs Gravel & Excavating, Inc. <br />3/26/13 <br />Exhibit A - Legal Description and Location Map (Rule 6.3.1(1)): <br />The legal description must identify the affected land, specify affected areas and be adequate to <br />field locate the property. Description shall be by township, range, and section, to at least the <br />nearest quarter - quarter section. A metes and bounds survey description is also acceptable. Also, <br />the street address or lot number(s) may be used. This information is available from the County <br />Assessor's office or U.S. Geological Survey (USGS) maps. <br />6. The Applicant provided a legal description by township, range and section, but only to the <br />nearest quarter section. Please provide a legal description to the nearest quarter - quarter <br />section for the proposed Harms Pit. The description must match the information provided for <br />Item #10 on the application form. <br />EXHIBIT A - Legal Description and Location Map (Rule 6.3.1(2)): <br />The main entrance to the mine site shall be located based on a USGS Topographic map showing <br />latitude and longitude or Universal Transverse Mercator (UTM). The Operator will need to specify <br />coordinates of latitude and longitude in degrees, minutes and seconds or in decimal degrees to an <br />accuracy of at least five (5) decimal places (e.g., latitude 37.12345 N, longitude 104.45678 W). <br />7. The Applicant provided a metes and bounds survey instead of specifying the main entrance <br />location in latitude and longitude or Universal Transverse Mercator. Please provide the main <br />entrance location in latitude and longitude or Universal Transverse Mercator and revise <br />Exhibit A accordingly. See Questions #4 and #5 above. <br />Exhibit C - Mining Plan (Rule 6.3.3): <br />The purpose of the mining plan is to describe how mining will affect the permit area for the <br />duration of the operation. This plan must be correlated to Exhibit E - Map. The description of the <br />mining plan must be adequate to satisfy the requirements of Section 3.1 and demonstrate <br />compliance with Rule 3. <br />8. The Applicant states the existing roads that will be used during the mining process are already <br />established, Weld County Roads 124 and 127, and there will be no new construction of roads. <br />Please clarify if the access roads from the mine site to the intersection of Weld County Roads <br />124 and 127 already exist and if they will require improvements to accommodate the mine <br />related traffic. <br />New or improved roads must be included as part of the permitted acreage. Therefore, if the <br />access roads require improvements the Applicant would be required to withdraw the 110c <br />Application for the Harms Pit and submit a 112c application package. <br />
