INTRODUCTION <br />SCC will apply for release of the reclamation bond held by the Colorado Division of Reclamation, Mining and Safety <br />(CDRMS). Per the guideline pursuant to Rule 1.15.4, Guideline Regarding Selected Coal Mine Bond Release <br />Issues,(CDMG, 1995), states.... " When Phase I bond release is requested, the release will apply only to those areas when backfilling <br />andgrading are completed Backfilling andgrading are considered completed upon the achievement offinalpost -mine topography in <br />accordance with the permit, including establishment of the approved permanent drainage system. Areas which do not quay for bond <br />release include long -term facilities such as sediment ponds, buildings, roads and other areas which will receive continued use in accordance <br />with the approved plan. " <br />SCC proposes to leave various structures as permanent features within the reclaimed area at the time of bond <br />release. These proposed structures are located on Exhibit 20 -2, Post Mine Topography and Drainage. The <br />retention of the structures has been requested by the current landowners. The landowner request letters are <br />contained in Appendix 20 -2.1, Surface Owner Request to Retain Permanent Features and Structures. The retention <br />of these structures will enhance the current postmine land use and landowner land use in the future. <br />The following discussions present the rationale, justification and /or documentation for retention of these features. <br />In some instances, the structure has already been approved as a permanent feature; in other cases approvals are still <br />required. In all cases, SCC has or will submit the required information for approval prior to applying for bond <br />release of an area containing a proposed permanent structure. <br />PERMANENT FEATURES /STRUCTURES <br />The structures proposed to be left as permanent features include the following: <br />• Access roads <br />• Light use roads <br />• Shop and Storage Area <br />• Water well <br />• Power line and substation <br />• Fenced shrub plots <br />• Sediment ponds <br />• Stock ponds <br />• Miscellaneous boundary and grazing fences <br />Rationale, justification, and documentation are provided in the following discussions to demonstrate compliance <br />with the approved reclamation and land use plan. <br />Access Roads <br />Landowner Access Road. (Road G, Rid <br />geline Access Road, Road J and Road K) <br />Rationale: This road will provide landowner access to individual properties within and adjacent to the II -W <br />reclamation area following final bond release. SCC will use this road in the interim as access for maintenance and <br />monitoring. <br />Justification: Without this road some individual properties would be "land- locked" with no readily available access. <br />The landowner request letter is contained in Appendix 20 -2.1 of this attachment. A recorded right -of -way <br />agreement between applicable landowners is contained in Tab 3, Appendix 3 -4, Right -of -Way Information. <br />Documentation: This road is approximately 5.7 miles in length (30,100 feet). The edges of the original roads have <br />been regraded, ripped, topsoiled and seeded to create the new average 20 foot wide limited access road. The <br />originally constructed road ditches and culverts are left inplace and supplemental culverts have been installed to <br />facilitate future maintenance. Portions of Road j and Road K were reconstructed to accommodate the Pond <br />TR -79 20 -2.1 10/12 <br />
