Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) received TR10 on February 14, 2013. The <br />application was found complete on February 6, 2013. The Division has completed its preliminary review and <br />there are several issues that will need to be addressed prior to the Division's approval of the application. Please <br />address the following items: <br />Tab 1; Hayden Gulch Loadout Permit Summary <br />1.) Please add MR -22 to the revised page 9 submitted with this revision. <br />Tab 3: Adiudication File <br />2.) Page 11 of Tab 03 indicates, "Attachment 3 -4 contains a copy of a typical newspaper advertisement and <br />proof of publication concerning the filling of a renewal and/or revision in the Steamboat Pilot." The <br />Division could not locate this attachment. Either submit an Attachment 3 -4 with a typical newspaper <br />advertisement or submit a revised page 11 that removes the sentence that this Attachment exists. If the <br />latter option is chosen, the Table of Content section for Tab 3 will need to be updated to remove a <br />reference to Attachment 3 -4. <br />3.) Page 3 -1.1 of Appendix 3 -1 was updated during TR7 in 2006. It does not appear this page was removed <br />or revised in subsequent revisions. Attached is a copy of this portion of Appendix 3 -1. In regards to <br />Item 47 of the Division's adequacy review of RN4, there is a discrepancy of acreages for the "Hayden <br />Gulch Loadout" portion of the permit acreage; it is likely this discrepancy is due to rounding. This page <br />is also missing in the electronic copy of the appendix on the Division's website. Page 3 -1.1 should be <br />included in Appendix 3 -1, please add it to your copy of the permit application package. <br />4.) In regards to Item 48 of the Division's adequacy review for RN4 for Appendix 3 -1, the legal description <br />of the Tie - Across Haul Road could not be located in the Division's hard copy of the permit application <br />package. This information is also not included in the Divisions electronic copy of the permit or in the <br />Divisions files with the revised pages for PR1.
