Kirby: <br />Thank you for your most recent correspondence dated March 6, 2013 (received by our office on March 11, 2013) <br />providing information as requested by our office on December 21, 2012. <br />We have reviewed and agree to the management conditions as outlined within "Attachment 1: Cultural Resource <br />Protection Plan for the Collom Mine Expansion (Permit Exhibit 5, Item 3)" and we understand that these <br />conditions will be added to the Colorado Division of Reclamation, Mining and Safety permit application as <br />enforceable requirements therein. Assuming these measures are implemented as described, we concur that a <br />finding of no adverse effect is appropriate for the proposed undertaking pursuant to 36 CFR 800.5(b). <br />We anticipate receiving the results of the baseline monitoring as well as an opportunity to comment on the <br />identification of the high potential areas for which construction monitoring will be required. <br />Should unidentified archaeological resources be discovered during the course of the project, work must be <br />interrupted until the resources have been evaluated in terms of the National Register of historic Places eligibility <br />criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
