On March 24, 1988 the Board conducted a hearing and found Rocky Mountain <br /> Constructors to be conducting the mining operation described above without a <br /> permit as required byIC.R.S; 34-32-101 et seq; <br /> 2; On March 24' 1988 the Board issued Notice of Violation and Cease and <br /> Desist Order M-88-002Ito Rocky Mountain Constructors; <br /> 24-4-101 3; On April 27; 1988 the Board conducted a hearing in accordance with C.R;S; <br /> et seq, to co <br /> Mountaiountain irons ructors: nsider assessment of civil penalities against Rocky <br /> • � : <br /> 4; The Mined Land Reclamation Division presented evidence at the Formal <br /> Public Hearing on Aprif 27, 1988, demonstrating that: <br /> a. On February 26; 1988, Adams County notified the Division that a <br /> mining operation was being conducted at the site and recommended that <br /> a limited-impapt (110) permit should be obtained for the operation; <br /> b; On March 22, 1988, an inspection of the site was conducted which <br /> indicated a mining operation was being conducted without a permit; <br /> - - C. Corrective actions to submit a reclamation-only permit application <br /> and provide a performance warranty and financial warranty for <br /> $2,000.00/acre ey March 31 ' 1988 have not been received from Rocky <br /> Mountain Constructors. <br />
