Rule 4.13 — Contemporaneous Reclamation <br />30. This item is considered complete. Colowyo has provided additional information <br />regarding the requested variance from contemporaneous reclamation on pages <br />Collom -Rule 4, pages 23 -25. These pages discuss the mining sequence, <br />contemporaneous reclamation and the proposed variance from contemporaneous <br />reclamation. The Division will further evaluate the request during technical <br />adequacy. <br />Rule 4.14 — Backfilling and Grading <br />31. This item is considered complete. Colowyo has corrected both Maps 23B — Mine <br />Plan, and 29B — Spoil Grading, based on the Division's 8 April 2010 comments. The <br />dates on the maps appear to correlate. The Division will review the mining and <br />reclamation schedules during technical adequacy. <br />32. This item is considered complete (8 April 2010). Colowyo has fixed the post- mining <br />topography as noted in the Division's 5 February 2010 incompleteness letter. A <br />detailed review of the proposed post- mining topography, as shown on Map 19C, will <br />occur during technical adequacy. <br />Rule 4.15.7 — Determining Revegetation Success: General Requirements and Standards <br />33. This item is considered complete (8 April 2010). The narrative provided in Section <br />4.15.7 addresses the Division's incompleteness concern. <br />Rule 4.15.8 — Revegetation Success Criteria <br />34. This item is considered complete. Colowyo has provided updated permit pages <br />Collom -Rule 4, pages 34 -40 and Map 46. These updates permit pages and map <br />include areas that will be targeted for grassland or sagebrush steppe reclamation. <br />They also include information regarding wildlife enhancement measures, such as <br />stock tanks. <br />Rule 4.16 — Post - Mining Land Use <br />35. This item is considered complete (8 April 2010). This section references information <br />in Section 2.04.3 and 2.05.5. Although additional information will need to be <br />provided to demonstrate Completeness for Section 2.04.3 and 2.05.5, as addressed in <br />Items 5 and 16 of this letter, the information provided in Section 4.16 is considered <br />sufficient to deem the Section 4.16 complete. <br />Rule 4.18 — Protection of Fish, Wildlife and Related Environmental Values <br />36. This item is considered complete.
