Rule 2.03.5 — Compliance Information <br />3. This item is considered complete (8 April 2010). The Division agrees that the <br />ownership and controller information required by Rule 2.03.5 was updated with the <br />approval of Minor Revision 98 (proposed decision date of 30 October 2009). Based <br />on the timing of the responses to this incompleteness letter and the length of the PR- <br />03 review the Division may request that this information be updated again. <br />Rule 2.03.12 — Newspaper Advertisement and Proof of Publication <br />4. This item is considered complete. The proposed public notice for PR -03 is included <br />at the end of Volume 15 as Figure 2.03.12 -2. Colowyo has amended the proposed <br />public notice as requested. <br />Rule 2.04.3 Site Description and Land Use Information <br />5. This item is considered complete. Colowyo has provided updated permit pages <br />Collom -Rule 2, pages 18 -20 and Map 17. This information provides minimal fish <br />and wildlife information required by Rule 2.04.3. Colowyo has also included an <br />updated pre and post- mining land use of fish and wildlife habitat (in addition to <br />rangeland) on Map 17. <br />Rule 2.04.6 — Geology Description <br />6. This item is considered complete (8 April 2010). While the Division still has <br />questions regarding the Collom area lithology and the generalized stratagraphic <br />columns, these questions will be handled in the technical adequacy review. <br />7. This item is considered complete (8 April 2010). Colowyo presented the requested <br />data in Exhibit 6, Item 10. The Division may have additional questions regarding the <br />technical adequacy of the materials presented. <br />8. This item is considered complete. Colowyo has provided the requested coal seam <br />quality data, including a breakdown of the types of sulfur (total, sulfate, pyritic and <br />organic). This information was submitted under a separate cover and is considered <br />confidential. <br />Rule 2.04.7 — Hydrology Description <br />9. This item is considered complete (8 April 2010). The Division would like to remind <br />Colowyo that pursuant to Rule 2.04.7(1)(iii), Colowyo will be required to reinitiate <br />groundwater monitoring at least one year prior to commencing the mining operations <br />associated with the Collom project.
