— STATUS OF STIPULATIONS
No stipulations have been associated or added to Permit C- 2009 -087 since the issuance of the
permit.
SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS
The Foidel Creek Mine permit does not include a variance under Rules 2.06.2 (experimental
practices), 2.06.3 (mountaintop removal), and 2.06.5 (approximate original contour (AOC) for
steep slope mining). No variance from contemporaneous reclamation for combined surface and
underground mining operations (2.06.7) is needed due to the Seneca 11 Mine ceased operations in
1999 and has been reclaimed, the excavated pit accessing the Wadge Seam to construct mine
portals and other facilities to support an underground mine is not considered surface mining, and
the Peabody Sage Creek Mine reclamation bond includes any remaining facilities from the
Seneca II Mine.
SECTION VI — BONDING SUMMARY
A compiled reclamation cost estimate was developed by the Division as a part of the Permit
Application process on May 7, 2010. The Division's reclamation costs have not been updated
since that date. However, a summary of those costs in addition to any revision adjustments has
been completed for this 2013 Midterm Review. As of February 20, 2013, the Division estimates
liability at the Foidel Creek Mine is $4,954,779.34. This amount is sufficient to assure
completion of the remaining reclamation work at the site if the work had to be performed by the
Division, including the cost of re- establishing vegetation on any revegetated areas, should those
areas fail. The permittee currently has on deposit with the Division one cash bond in the amount
of $6,160,431.65.
Based on the updated costs of associated revisions the direct costs for all reclamation tasks is
$3,949,764.10. This is less that the direct costs of $4,735,596, calculated for the Peabody Sage
Creek Mine upon approval. Indirect costs consist of the Overhead and Profit costs and the Legal,
