No variance from contemporaneous reclamation for combined surface and <br />underground mining operations (2.06.7) is needed due to the Seneca 11 Mine ceased operations in <br />1999 and has been reclaimed, the excavated pit accessing the Wadge Seam to construct mine <br />portals and other facilities to support an underground mine is not considered surface mining, and <br />the Peabody Sage Creek Mine reclamation bond includes any remaining facilities from the <br />Seneca II Mine. <br />SECTION VI — BONDING SUMMARY <br />A compiled reclamation cost estimate was developed by the Division as a part of the Permit <br />Application process on May 7, 2010. The Division's reclamation costs have not been updated <br />since that date. However, a summary of those costs in addition to any revision adjustments has <br />been completed for this 2013 Midterm Review. As of February 20, 2013, the Division estimates <br />liability at the Foidel Creek Mine is $4,954,779.34. This amount is sufficient to assure <br />completion of the remaining reclamation work at the site if the work had to be performed by the <br />Division, including the cost of re- establishing vegetation on any revegetated areas, should those <br />areas fail. The permittee currently has on deposit with the Division one cash bond in the amount <br />of $6,160,431.65. <br />Based on the updated costs of associated revisions the direct costs for all reclamation tasks is <br />$3,949,764.10. This is less that the direct costs of $4,735,596, calculated for the Peabody Sage <br />Creek Mine upon approval.
