o The operator has received Division approval for a new gob pile, Gob Pile #3. <br />DRMS approval was on July 3, 2007. This refuse area has been prepared <br />for refuse disposal (topsoil and subsoil removed and stockpiled, sediment <br />control in place), but BRL has not been able to transport material to this new <br />refuse area because they have yet to receive approval from the Air Quality <br />Control Division of the Department of Health and Environment. <br />Pertaining to Good Faith — There were three steps required to abate the violation: <br />Step 1 - Provide all materials necessary to obtain approval for Technical Revision <br />No. 76 to authorize disturbance, by February 12, 2013. <br />Step 2 - Post appropriate financial warranty for existing disturbance and any <br />additional proposed disturbance, by February 12, 2013. <br />Step 3 - Save all topsoil in accordance with Rule 4.06.2, by February 12, 2013. <br />Step 1 was completed on January 11, 2013. <br />Step 2 was completed on January 28, 2013, with DRMS acceptance of a rider <br />submitted by BRL on January 24, 2013. <br />Step 3 has been extended until February 27, 2013. <br />The violation notice has not been terminated, since Step 3 remains outstanding. <br />
