This 1.48 acres of 2012 actual impact mitigation was <br />reduced from the original 2.77 acres of mitigation as permitted in the 2011 BA, since the impact <br />was approximately 50 percent less than originally permitted (see Table 1). <br />The actual Phase 1 mitigation to be completed at the end of Phase 1 construction activities as <br />shown on Table 2 includes a total of 0.79 acre of mitigation. Of this 0.79 acre, 0.09 acre of <br />upland area enhancement will include the planting of 150 upland shrubs in a 0.09 acre area. <br />This mitigation was part of the originally permitted mitigation for the same amount of permanent <br />upland impact. An additional 0.59 acre of temporarily impacted uplands will be restored through <br />seeding and mulching and planting with the required upland trees and shrubs that were <br />calculated as to actually having been impacted. In this case, there were two small upland trees <br />and 37 upland shrubs impacted (see Table 3). Due to the mitigation calculations of shrubs <br />being replaced at the ratio of 1:1.5 and small trees being replaced at the ratio of 1:1 (if Tess than <br />6 inches in diameter), the required upland trees and shrubs will total 2 upland trees and 58 <br />upland shrubs replaced within the 0.59 acre restored upland area (see Table 3 for 2012 Actually <br />Impacted Trees and Shrubs). This upland area is located adjacent to and south of the upstream <br />cut -off wall where there is a vehicle turn - around. The actual vehicle turn - around area is not <br />currently included as part of the Phase 1 mitigation but will be part of upland mitigation at the <br />end of Phase 3. <br />Schwartzwalder Mine Actual Area Impact Page 5 <br />January 2013 <br />
