(Cotter) in 2012 at the
Schwartzwalder Mine (the Site) located in Golden, Colorado. These construction activities were
detailed in the August 2011 Wright Water Engineers Inc. (WWE) Pre - Construction Notification to
the USAGE for the proposed "Ralston Creek Temporary Diversion Project ". The USACE file
number for the project is NOW- 2011- 1353 -DEN. This project involved the Phase 1 installation
of an upstream cut -off wall across the creek and the installation of an 18 -inch pipeline around
the Site. The USACE permit for this proposed work was obtained on November 25, 2011.
As part of the Phase 1 permitting process, the USAGE consulted with the USFWS regarding the
project because Ralston Creek is considered critical habitat for the federally threatened Preble's
Meadow Jumping Mouse (PMJM) (Zapus hudsonius preblei). IRIS Mitigation and Design, Inc.
(IRIS) prepared a Biological Assessment dated August 2011 as a required part of the USACE
Pre - Construction Notification process regarding the PMJM and associated habitat impacts.
